Unlike previous studies that predominantly examine the relationship between business ethics and loyalty from a conceptual or quantitative perspective, this research offers novelty by adopting a phenomenological approach to capture traders’ lived experiences in daily transactions. The study employs a qualitative phenomenological method through in-depth interviews and observations with purposively selected traders and consumers. The findings reveal that Islamic business ethics are understood by traders as practical guidelines emphasizing honesty, fairness, and consistent service. This understanding contributes to the development of consumer trust, which subsequently fosters loyalty and repeat purchase behavior. This research employs normative legal methods with a conceptual and case-based approach, analyzed through the theoretical framework of <em>ushul fiqh</em> (Islamic jurisprudence), specifically maslahah mursalah. The results indicate that although the JPH regulation aims to protect the interests of Muslim consumers (<em>hifz al-din</em>), its universal and bureaucratic application has the potential to generate significant harms, including economic burdens for MSMEs, administrative complexity, and the risk of commodifying religious values. From a <em>maṣlaḥah mursalah</em> perspective, the expected benefits have not convincingly outweighed the harms caused, particularly to vulnerable business groups. The approach used is descriptive quantitative with data collection techniques through surveys and interviews conducted directly with MSMEs. The research instrument is a questionnaire that has passed the validity test using Pearson correlation and reliability test using Cronbach's Alpha so that the data obtained can be used as a basis for analysis. The results of the study show that the average value of halal Awareness of MSMEs is 4.68 which is in the high category, which indicates that most respondents have a good understanding and concern for the halal aspects of products. Meanwhile, the average interest of MSMEs in the free halal certificate program is 4.34 which is also included in the high category, which indicates that business actors realize the importance of free halal certificates as a guarantee of consumer trust. Based on these findings, it can be concluded that MSMEs in the Tanjungputa University (UNTAN) environment have generally shown a positive attitude towards the halal concept and the legality of halal products. This research is motivated by the phenomenon of a significant increase in the Hajj Pilgrimage Cost (Bpih), which is not balanced by a proportional increase in pilgrim deposits (BIPIH), thus forcing the excessive use of Benefit Value (investment returns). Through a qualitative approach with descriptive-critical and normative-juridical analysis methods, this study dissects the financial report data of the Hajj Financial Management Agency (BPKH) for 2018-2024 and projects its impact until 2026. The research findings indicate that the current intergenerational cross-subsidy scheme has violated the principle of Intergenerational Equity as theorized by Richard Musgrave, and is contrary to the Islamic economic principle of Monzer Kahf regarding distributive justice and consumption rationality. Furthermore, this practice is indicated to have structural similarities to a covert Ponzi scheme, where the financial rights of waiting-list pilgrims are eroded to finance those currently departing. This analysis is strengthened by the issuance of the Decree of the VIII Indonesian Ulema Council of Fatwa Commissions in 2024, which prohibits the use of investment proceeds from prospective Hajj pilgrims' initial deposits to finance other pilgrims. This article concludes the need for a redefinition of istitha'ah (Islamic principle) that returns to financial independence, enforcement of actuarial discipline in accordance with Law No. 34 of 2014 concerning Hajj Financial Management, and implementation of Maqashid Sharia (Islamic Principles) in terms of asset protection (hifz al-mal) to ensure the sustainability of the congregation's funds.</p>2025-12-26T00:00:00+00:00Copyright (c) 2025 Robi Sagara
